1、課程說明

卡爾‧史密特（Carl Schmitt, 1888-1985）是一位備受爭議的人物，其法政思想具有不可忽視的份量，值得深入地加以探討。近幾十年來，史密特更受到英美學界（包括左派與右派的學者）的重視，許多著作的英譯與二手研究專著紛紛出版。

為了對史密特的法政思想有較為全面且公允的理解，本課程將由史密特的重要著作發表的先後順序，逐一研讀並討論史密特的法政思想，尤其將著重史密特對法實證主義與自由主義的批判以及他晚期關於戰爭法與國際法的思想。

4、教學方式

基本上針對卡爾‧史密特的重要著作進行研讀、分析與討論。修課的同學必須選定所要研讀的文本，進行1-2次的針對選讀文本的口頭報告。

5、教學進度

前三個星期為導論，先一般性地介紹卡爾‧史密特的法政哲學思想的時代背景及特色，並對史密特早期的著作的主要內容進行討論（其中許多文本尚無中譯及英譯，將發下我的部分中譯）。第四週開始，即進行原典的研讀與討論。

6、成績考核

平時成績50 %：主要為口頭報告及參與討論的表現

期末報告50 %：每位修課同學須繳交一份5000-10000字的期末報告。
